Terms of Service

1. Services

JHR Photography provides photography and related media services, including corporate event and conference coverage, headshots and executive imaging, event video, and high-school senior portrait sessions and experiences. We serve the Nashville and Clarksville, Tennessee area and travel nationally. Deliverables, timelines, image rights, and pricing for a specific engagement are set out in an individual service agreement, which is separate from these Terms.

2. Eligibility & Minors

To book services, sign agreements, or make payments, you must be at least 18 years old and able to enter into a binding contract. By doing so, you represent that you meet these requirements.

Minors (such as high-school seniors) may be photographed and may complete a questionnaire as part of a session arranged with a parent or guardian. If you provide information about a minor, or a minor completes a questionnaire, a parent or guardian must consent and is responsible for that participation. Do not submit another person's information without their permission (or, for a minor, the permission of their parent or guardian).

3. Intellectual Property

All content on the Site, including photographs, text, logos, graphics, video, and design, is owned by JHR Photography LLC or its licensors and is protected by copyright and other laws.

• You may not reproduce, distribute, modify, publicly display, or use any Site content without our prior written permission.
• Photographs we create remain our intellectual property unless a separate written agreement says otherwise. Client usage rights are defined in the service agreement and do not transfer copyright ownership.

4. Image Use & Model Releases

Images we capture are subject to your service agreement and any model release you sign. At public-facing engagements such as corporate events and conferences, attendees acknowledge that photographs may be taken and used consistent with the event client's agreement. For senior sessions, image-use permissions are opt-in and provided by the parent or guardian. How we handle personal information related to images is described in our Privacy Policy.

5. Your Submissions

When you submit a form, questionnaire, or reference materials, you confirm that the information is accurate and that you have the right to share it. You grant us permission to use your submissions to respond to you and to plan and deliver our services. Do not submit anything unlawful, infringing, or that you are not authorized to share.

We use AI-assisted tools to help organize submissions and prepare media, as described in our Privacy Policy. Our team reviews the work we deliver; AI is a tool that supports us, not a substitute for our judgment.

6. Booking & Payment

Bookings are subject to availability and a signed service agreement. Payment terms, deposits, and cancellation and rescheduling policies are set out in that agreement.

• A non-refundable retainer may be required to reserve your date.
• Payments are processed by a secure third-party processor (Square). We do not store your card number on the Site.

7. Communications

When you contact us or submit a form, you agree that we may respond by email or phone about your inquiry and our services. Marketing emails are sent only to people who opt in, and you can unsubscribe at any time. Text-message (SMS) updates are covered in the SMS Program Terms below.

8. SMS Program Terms

JHR Photography operates a text-messaging program for our Senior Experience. By providing your mobile number and opting in, you consent to receive recurring automated text messages from us about your session and experience, such as your link to continue or return to your questionnaire, a confirmation when you submit, and a notice when your experience page is ready. If you separately opt in to offers, you may also receive occasional news and offers.

• Message frequency varies.
• Message and data rates may apply.
• Consent to receive texts is not a condition of any purchase.
• Reply STOP at any time to cancel. Reply HELP for help, or contact us at the email below.
• Carriers are not liable for delayed or undelivered messages.

How we handle the mobile information you provide, including that we never share or sell your opt-in data, is described in our Privacy Policy.

9. Acceptable Use

You agree to use the Site only for lawful purposes. You may not:

• Violate any applicable law or regulation.
• Attempt to gain unauthorized access to the Site, accounts, or systems.
• Use bots, scrapers, or automated means to collect data from the Site without our written permission.
• Interfere with or disrupt the Site's operation or security.
• Download, copy, or redistribute photographs or other content from the Site.

10. Disclaimers

The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including regarding accuracy, availability, and fitness for a particular purpose. This section does not limit any warranty expressly made in a signed service agreement.

11. Limitation of Liability

To the fullest extent permitted by law, JHR Photography LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services. Our total liability for any claim relating to our services will not exceed the amount you paid for the specific service giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless JHR Photography LLC and its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your submissions, your violation of these Terms, or your infringement of any third-party rights.

13. Third-Party Links & Services

The Site may link to or rely on third-party websites and services we do not control. We are not responsible for their content, practices, or terms. Your use of third-party services is governed by their own terms and policies.

14. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the Site will be resolved in the state or federal courts located in Montgomery County, Tennessee, and you consent to their jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted, and we will update the Effective Date above. Your continued use of the Site after changes are posted means you accept the updated Terms.
